New MCS Rules Let Housing Societies Hold AGMs via Video Conferencing

Managing committees can now let members attend annual general meetings (AGM) and special general body meetings (SGM) online, under the Maharashtra Co-operative Societies (Amendment) Rules, 2026, effective from 30 June 2026. The rules formally recognise video conferencing and other audio-visual means as a valid mode of attendance for cooperative housing society meetings, alongside in-person participation.

What the rules require

A society offering virtual attendance must use a platform capable of recording proceedings, recognising individual members, and logging participation with date and time. The meeting notice must carry the video conferencing link in advance, and the chairperson or returning officer must verify quorum — two-thirds of total members, or twenty members, whichever is lower — before the meeting is called to order.

Quorum and voting

Members joining by video link count toward quorum the same way as those present in the hall, and their votes carry equal weight. Resolutions still require a majority of 51% of members present, whether online or in person. The option also extends to Special General Body Meetings called specifically to approve redevelopment proposals — a category where disputes over notice and attendance have often ended up before the Co-operative Court or the Bombay High Court.

What this means for housing societies

• Committees should update AGM and SGM notice templates to include the video conferencing link and a note on how virtual quorum will be verified.
• Societies must preserve the meeting recording as part of statutory records, since it can be examined if a resolution is later challenged.
• Elderly and NRI members who could not previously attend in person now have a documented right to participate and vote remotely.
• Redevelopment SGMs, often the most contested meetings a society holds, can proceed with wider member participation, narrowing the grounds for later challenge over notice or attendance.

Societies planning an AGM or a redevelopment SGM in the coming weeks should confirm their notice format, video conferencing platform, and recording arrangements comply with the new requirement before invitations go out.
