Reminder: Housing Societies Now Follow a Separate Rules Chapter; Several General Co-op Rules Do Not Apply
Under the MCS Amendment Rules 2026, new Rule 106C-1 states that a list of general co-operative society rules does not apply to housing societies. Committees should check which rulebook they are relying on before acting.
No fresh circular or court ruling on housing societies was confirmed today, so this is a reminder of a structural change in the Maharashtra Co-operative Societies (Amendment) Rules, 2026. According to a law-firm analysis, the amendments were notified by the Co-operation, Marketing and Textiles Department on 18 June 2026 and published in the Government Gazette on 22 June 2026. The analysis does not state a separate commencement date.
A separate rulebook for housing societies
The amendments add dedicated provisions for co-operative housing societies. Under a new Rule 106C-1, the analysis reports, Rules 4, 19, 20(1), 22, 25, 27, 30A, 35 to 48 and certain other provisions of the general rules do not apply to housing societies. The analysis does not describe what those excluded rules contain, so the Gazette text must be checked for details.
In plain terms, the general rules framed for all co-operative societies, such as credit societies or dairies, are no longer the automatic reference point for a housing society on the listed subjects. The housing-specific provisions take their place.
What this means for housing societies
- Before relying on an old practice or an older circular, confirm that it is not based on one of the rules now excluded for housing societies.
- Committees, secretaries and auditors should keep a copy of the Gazette text of the 2026 Rules, rather than a summary, for reference.
- Where a rule number is quoted in a notice, resolution or reply to a member, check it against the housing-specific chapter first.
- Items such as fund minimums, service charges, the borrowing limit and redevelopment meetings are dealt with in the new housing provisions.
Societies unsure which provision governs a particular act should consult the jurisdictional Deputy or Assistant Registrar or a qualified professional. The analysis is secondary commentary and does not replace the Gazette notification.
