Registrar Circulates Draft Model Bye-Laws Text, Objections Due 27 August

The Co-operative Commissioner and Registrar of Co-operative Societies has released the actual draft text of the revised Model Bye-Laws for housing societies, inviting public objections until 5 pm on 27 August 2026.

The Office of the Commissioner for Co-operation and Registrar of Co-operative Societies, Maharashtra State, has circulated the full draft text of the revised Model Bye-Laws for cooperative housing societies. This follows an earlier announcement that a single, updated set of bye-laws would replace the 2014 version for all 1.25 lakh-plus registered housing societies in the state.

What the draft covers

The draft text lays down updated provisions on society membership, associate and provisional members, nominations and family arrangements, virtual and hybrid Annual General Meetings, sinking fund requirements, redevelopment procedures, and recovery of dues from defaulting members. It is intended to align each society's bye-laws with the framework already introduced through the Maharashtra Co-operative Societies (Amendment) Rules, 2026.

How to respond

The Registrar's office has invited suggestions and objections from societies, managing committees, and members on the draft. These must be submitted by email to coophsgmodelbyelaws@gmail.com before 5 pm on 27 August 2026. The department has indicated the final Model Bye-Laws will be notified for adoption from October 2026, once objections are reviewed.

What this means for housing societies

  • Managing committees should read the draft text carefully and flag any clause that conflicts with their society's existing practices before the 27 August deadline.
  • Once the final bye-laws are notified, societies will likely need to adopt them in place of their current 2014-format bye-laws through a General Body resolution.
  • Societies that have already aligned fund contributions, interest on dues, and non-occupancy charges with the MCS Amendment Rules, 2026 should find fewer changes needed at adoption stage.

Committees that wish to raise concerns about the draft have until 27 August 2026 to do so. After that date, the objection window will close and the Registrar's office is expected to finalise the text ahead of the planned October 2026 rollout.
