Only Five Days Left to Object to Maharashtra's Draft Model Bye-Laws
Societies have until 5 pm on 27 August 2026 to email objections or suggestions on the Registrar's draft revised Model Bye-Laws, which will replace the 2014 version for all 1.25 lakh-plus housing societies in the state.
With the objection window closing on 27 August 2026, only five days remain for cooperative housing societies in Maharashtra to review and respond to the Registrar's draft revised Model Bye-Laws. The draft, circulated earlier this month, is meant to replace the 2014 Model Bye-Laws for all 1.25 lakh-plus registered housing societies in the state and to align each society's governing rules with the Maharashtra Co-operative Societies (Amendment) Rules, 2026.
Why this matters
Model Bye-Laws are the template rulebook that individual societies adopt, with local modifications, to govern membership, meetings, maintenance charges, and redevelopment. Once the state finalises this revision, expected to take effect from October 2026, existing societies will eventually need to update their own bye-laws to match. Committees that skip reading the draft now may find themselves adopting provisions later without having had a say in shaping them.
What the draft changes
The draft text sets out updated provisions on membership and associate members, nominations and family arrangements, virtual and hybrid Annual General Meetings, sinking fund contributions, redevelopment procedures, and recovery of dues from defaulting members -- largely mirroring the framework already notified under the 2026 Amendment Rules, such as the 12% cap on interest for overdue dues and the 10% cap on non-occupancy charges.
What committees should do before 27 August
- Have the managing committee, or at least the secretary and treasurer, read through the full draft text rather than relying on summaries.
- Flag any clause that conflicts with the society's existing bye-laws or an ongoing redevelopment agreement, since these will need reconciliation once the new bye-laws are adopted.
- Email specific, clause-referenced objections or suggestions to coophsgmodelbyelaws@gmail.com before 5 pm on 27 August 2026 -- general comments without clause references are less likely to be considered.
- Keep a copy of whatever is submitted for the society's records, since the final gazetted version may take months to arrive after the objection window closes.
Societies that miss the 27 August deadline will not be barred from adopting the eventual bye-laws, but will lose the chance to influence their final wording. The Registrar's office has not yet indicated whether the window will be extended.
