The statutory deadline for co-operative housing societies in Maharashtra to hold the annual general meeting (AGM) for FY 2025-26 ends today, September 30. The annual return to the Registrar is due by the same date. The AGM is the yearly meeting where all members approve the audited accounts, the budget and the appointment of the auditor.
What the 2026 rules changed for meetings
The Maharashtra Co-operative Societies (Amendment) Rules, 2026, notified on June 18, 2026, added Chapter XI-B specifically for housing societies. Under Rule 106C-13, members may attend a general body meeting in person or through video conferencing or other audio-visual means, provided the proceedings can be recorded.
Quorum, meaning the minimum attendance needed for the meeting to be valid, is two-thirds of members or 20 members, whichever is less. Resolutions pass by a 51% majority.
What this means for housing societies
- A society that cannot gather enough members physically can still meet quorum by allowing recorded video-conference attendance.
- Keep the recording and the attendance record, as the rules expect proceedings to be capable of being recorded.
- The audited accounts for the year should be placed before the AGM, so the statutory audit must already be complete.
- Committees that miss the deadline should ask their Deputy Registrar how to regularise the delay rather than skip the meeting altogether.
Societies that have not yet held the meeting should confirm the notice period in their bye-laws immediately, since a meeting held without valid notice may be challenged by members. Check with the Registrar's office for any extension notification before relying on one, and file the annual return as soon as the AGM is completed.
